摘要：在我国广大的农村中小学,特别是西部中小学,还存在着教育行政部门与代课教师不签订劳动合同等编制外非法用工的情况。近年来,代课教师问题成了一个难以处理且社会影响较大的社会问题,"代课教师"一度成为社会不公的代名词之一。代课教师面临着政策解读、聘用合同法律适用及维权等现实问题。对于这些问题,应适用《劳动法》进行规制,同时应使社会保障措施跟进,事业单位编制工作科学化,建立行政补偿和赔偿机制,对作出贡献的代课教师予以政策倾斜以及推行教师交流制度等措施来促进问题的解决。
In China, some administrative departments for education do not sign labor contracts with substitute teachers in rural primary and middle schools, especially in western rural primary and middle schools. Nowadays the iLssue of substitute teachers has become a social problem difficult to handle. The substitute teachers face some difficulties such as policy understanding, application of law for contract and maintain legal rights. For these diffic- ulties, there are many measures to be taken to promote the settlement such as the application of labor law, the social security measures＇ following up, the scientific formation work of public institution, the establishment of administrative compensation and compensation mechanism, policy preferences to these substitute teachers who made more contri- bution and the implementation of teacher exchange system.
