摘要：在我国,由于国家建设用地使用权的期限性和地上建筑物存续期间不一致,再加上我国没有采用土地吸附房屋的一元立法模式,因此会产生建设用地使用权届满后续期的问题和地上建筑物归属等诸多难以解决的问题。我国《物权法》的出台和实施,并没有解决建设用地使用权届满后的续期问题和地上建筑物的归属问题,因此对我国物权法及相关法律法规对建设用地使用权届满后续期的问题和地上建筑物归属的立法进行分析,提出明确的续期期限、次数和出让金数额等立法建议,具有很强的现实意义。
In China, because of the inconsistency of the expiration term of the right to use the state- owned construction land with the duration of the above-ground structures, and the adoption of the legislation mode other than that of land adsorption housing, it is not easy to settle such issues like ex- tending the contract and confirming the adscription of above-ground buildings, which remain unsolved since the establishment and the implementation of The Right Law of the People＇s Republic of China. The paper analyzes the relevant laws and regulations on those problems, thus putting forwards mak- ing legislation clearly on the extension term, the renewal times and transfer fee.
