摘要:在我国,由于国家建设用地使用权的期限性和地上建筑物存续期间不一致,再加上我国没有采用土地吸附房屋的一元立法模式,因此会产生建设用地使用权届满后续期的问题和地上建筑物归属等诸多难以解决的问题。我国《物权法》的出台和实施,并没有解决建设用地使用权届满后的续期问题和地上建筑物的归属问题。本文试图对我国物权法及相关法律法规对建设用地使用权届满后续期的问题和地上建筑物归属的立法进行分析,提出了应明确续期期限、次数和出让金数额等立法建议。
In China because due time limit of the state-owned construction lands and the duration of the above-ground buildings are not the same, and the unitary legislative mode of adsorption of housing land isn't adopted in China, there are many tough problems such as the adscription of above-ground buildings after the expiration of the state-owned construction land. With the implementation of Real Right Law of the People's Republic of China, those issues haven't been solved. The author tries to analyze the relevant laws and regulations on those problems, and puts forwards some legislation advice on making certain the renewal time limit, times and the amount of the paid-in land transfer fund.
