摘要：我国《侵权责任法》的颁布实施,标志着对民事权益的保护进一步加强。侵权责任免责事由是侵权责任法的一项重要规定,但是由于我国采纳大陆法系的立法传统,在侵权责任立法方面特别是免责事由方面存在不易理解的方面。文章试图对与侵权责任免责事由相关的概念,如:侵权行为、侵权责任和侵权责任构成要件、侵权抗辩事由和侵权责任违法阻却事由等概念进行简要的分析,并对我国《侵权责任法》中免责事由的规定进行了简要的评析,提出了自己的立法建议。
The issuing and implementation of Tort Law of China indicates the strengthening of protection of civil rights and interests. The regulation of exemption excuses of tort liability is very essential. But because our country follows the tradition of law making of civil law system, there are many aspects difficult to understand on the legislation of tort law, especially on exemption excuses. The author tries to analyze briefly some conceptions related to exemption excuses of tort law, such as tortuous conducts, liability for tort, constitution of tortuous conducts, counterargument excuses, ground for elimination of illegitimacy and exemption excuses, comment on Comments on exemption excuses of tort law of china, and put forwards advice for legislation.
