摘要：我国法律对监护人责任的规定独树一帜,更有利于对受害人的保护,但是由于立法中未予明确监护人的责任类型,缺乏对相关概念的进一步界定,对被监护人的规定有违公平原则和责任自负原则,不利于被监护人的成长,导致了理论界和实务界对其理解的混乱,不利于理论研究和司法实践。本文对学理上与监护人责任相关的责任类型概念进行了分析,认为我国的监护人责任是一种新的责任承担方式,其兼具自己责任、替代责任和补充责任的一些特点,同时对其不足之处进行简要评析并提出相关建议。
The regulation of guardian＇s obligations of China is unique and it gives the victim more protection. But it brings about the confusion of understanding in theoretical circles and practitioners and goes against the development of the person under guardianship because the lawmaking doesn＇t make the style of guardian＂ s obligations certain,lacks further definition of the conceptions and some regulations violate the principle of fairness and the principle of direct liability and it goes against the theoretical research and judicial practice. The author analyzes the relative conceptions with guardian＇s obligations, comes to the conclusion that guardian＇s obligations of China is a new type of mean of responsibility assumption with the characteristics of direct liability,vicarious liability and complementary liability and tries to define the guardian＇s obligations, gives a brief analysis on the limitations, and puts forward relevant proposals.
